NYMW Whitby services run under specific local "rules" which apply exclusively between Whitby - Battersby and Whitby - Pickering

Exactly what are those then Fred?

Each operators' Safety Management System, Track Access Contract and Public Liability Insurance are as necessary for the nature and extent of their operations. Any operator of Mark 1 stock requires exemptions from certain provisions of the Railway Safety Regulations 1999 and any operator of Steam Locomotives requires around 80 exemptions from Group Standards. These are granted to each locomotive, and some NYMR locomotives have an extra one of exemption from the Group Standard Requirement to fit OTMR.

So, it would be perfectly possible for Tysley to apply for a mainline Safety Certificate and Track Access Contract, but that process would realistically take a good 6 months from a standing start. Based on the news relayed by Railway Herald this morning, they may well see no need to do so!

On Tuesday we will put out a notice to all the affected passengers as soon as we are 100% sure what we are able to run and when. As I am sure you can imagine, there is a lot to discuss and confirm with WCRC.

    We appreciate your patience.

    Regards, Ben - VT

Shakespeare Headcodes are usually 1T50 - 53 so 5T50 seems on the money, won't be activated until the SE season mind.

I can't find precise details of the arrangements but I recall that locos operating outside the NYMR boundaries need specific equipment (e.g. TPWS) to allow operation on the Esk Valley line but it is less than that required for locomotives to operate on the national network. Although main-line registered steam locos have been used on Esk Valley workings I understand that Standard Class 4 75029, Class 24 D5032 / 61 and Class 25 D7528 have been certified for Esk Valley use but not main-line use under this arrangement.

The TPWS equipment is a standard fit. D5061 and D5032 are not mainline registered. "Esk Valley only" locos merely have an exemption from OTMR which applies only between Whitby and Battersby. The Mark 1 Exemption is actually still to Middlesbrough, although it is many years since any of the NYMR fleet carried passengers beyond Battersby.

The specific equipment fitted to individual locos clearly can affect where and how they are operated, but has no effect on the Track Access Contract of Safety Certificate/SMS as such. Hence, in response to the original question, yes, if they wished, Tysley could apply to become an operator and could chose to do so just for the Shakespeare Express route if they so wished (and still use WCRC for other tours for example), but I suspect they would consider they would have no reason to do so at the present time!

Thanks for confirmation of the precise "restriction"; i couldn't find owt on t'internet to say what specific conditions applied hence my vague reply. I also thought that the pair of Class 24s were "Esk Valley Approved" or has their licence period run out ?

The 24s have never been registered for mainline/Whitby use. D5032 has been out of action for many years, long before the NYMR even thought about going to Whitby. D7628 is the only non-steam loco passed for Whitby.

Very interesting post, and to me exemplifies one of the great strengths of Nat Pres, a mine of information, knowledge and expertise from which we can all benefit,

I'm sure @Ben Vintage-Trains can best update us with future plans for VT , however reading the Network Rail letter it speaks of a phased reintroduction so I suspect the one off tours will return later in the year with a focus on the Shakespeare's to start
