Triassic moves to Statfold

    According to the latest Bala Lake Railway magazine, they have still not been able to contact Bryce Latham and thus Triassic is still just sitting in the shed at Llanuwchllyn (or is it still at Statfold?). Do any legal eagles reading this know what the law says about abandoned property? It would appear that the owner has not been in touch at least since the previous posts on this thread (about 7 years!). At what point could the BLR say this is now ours, and either repair it or sell it on?

    I just checked the magazine and it says Triassic is sitting in the carriage shed at the BLR.

    I don't think we should speculate on this without knowing what was agreed between the railway and the loco owners. It's their business.

    Not speculate! ;) Might as well close down the forum then!!:D It would nevertheless be interesting to know when abandoned property becomes the property of the abandonee - especially given the iconic nature of this loco.

    In any case, the BLR are appealing in their magazine for anyone with info about how to contact Bryce Latham. Anyone reading this know how to contact him? As they have appealed for this information I think we can safely understand that they are happy for this not to be just 'their business' :cool:

    Brief checking up seems to suggest - assuming there is no contract saying otherwise - the Railway would have to wait 5 years, and show serious attempts to contact the owner, before they could dispose of abandoned goods. Proper legal advice would of course need to be taken.

    Spare a thought for the owner. If he has disappeared he may be in trouble and have serious problems to cope with - personal, financial, health etc. It can happen to anyone.

    My wife tells me a Tort Notice is the solution. Serve a notice to the last known address of the owner that they come and move it or the railway will sell it.

    Anyone in the know from Rheilffordd Llyn Tegid able to comment on attempts to contact Bryce Latham? Would a place to start not be the solicitors who dealt with his father's will? That should be discoverable through public records.

    AFAIK, it is still at Stotfold. If Bryce Latham has still not been contacted, it may well be that RhLlT has taken ownership (as per earlier posts on abandoned property) but, if so, it does not say so on their website.

    As a volunteer at Bala, all I can say is that the management and board are trying to get a response from the owner. Legal advice is that it cannot claim possession. The railway would like to restore it - work was carried out on the chassis in the 2000s - but it requires substantial repairs to the boiler, which the railway won't pay for without a guarantee that it will remain there.

    Lovely to see Triassic out for a run with Liassic. I hope the BLR manage to find Bryce Latham and can reach an agreement. It would be lovely to see Triassic back in steam.

    It surely must be possible to find a private investigator who's a railway fan who could track down Mr Latham for a minimal fee? Or is it a case of they know where he is but he just doesn't reply? Then a visit in person might be a way forward?
