    Not sure it will make much difference to attendance at Galas if I attend a gala I tend to do two things if the sun is out I take photos otherwise I travel no one knows if photographers contribute or not as you cannot tell if they are shareholders or have donated to various projects associated with the railway Kinchley lane is probably overgrown due to a lack of volunteers to cut it all back last time it was done was by a group of photographers who were attending a charter.
    How long before Photocharters go the same way.

    Would such conditions be enforceable in law? Judges don’t like limitations of liability much, if at all, and the rules around what can be limited are guaranteed to get our internal counsels’ brows to furrow.

    Is the answer for keen photographers to attend the many 'charter'type events? I don't know how the cost compares but you'd be free of the pesky public and stray tango types too? (I've never felt the urge to go lineside myself.)

    Would not stop the relatives of someone killed or injured going after the railway and hence their insurers. I am not even sure these days if such clauses are legally enforceable.

    The GCR doesn't get many charters these days as they are under the control of just one organiser who can't be everywhere as he has his business and other events to run. Plus it can cost around £75 plus to attend such an event and not many people are keen to shell out that sort of money.

    Re: Lineside Photographers

    In an effort to minimise risk and because of increasing pressure from various bodies, including our insurers, we have reviewed our policy for allowing lineside access for photographers. Our board and management team have decided to rescind this policy, and as a result we will be cancelling all previously issued lineside permits with effect from 1st January 2019.

    If you have already paid for a permit which covers a period beyond 1st January 2019 please consider which of the following options you wish to take up with respect to the outstanding period:

    · Donation to Great Central Railway PLC’s supporting charity, the David Clarke Railway Trust according to the details on the slip below.

    · Refund by cheque of the outstanding amount according to the details on the slip below.

    Whilst this decision will, no doubt, be unpopular and cause disappointment, we are sure that you will appreciate that it has not been taken lightly and has been made as a direct result of pressure upon our health and safety commitments.

    In the nanny state world in which we live once any organisation receives consideration for a service they have a duty of care under H&S legislation. Stating the activity is at your own risk doesn't get them off the hook. What we need is a change in legislation that does allow an adult to be responsible for their own well being. This move will probably just result in people trespassing on the line rather than paying and it will be uncontrolled

    Liabilty for Death or personal injury can not be excluded by contact law. Therefore such a clause isn’t worth the paper it is written on.

    OK as long as they get the go ahead from their insurer. See post above, by accepting money they have acc pets a duty of care. They could do what one farmer by the SVR does, he's happy for anyone to use his field as long as you ask and he asks for a voluntary donation to the local air ambulance

    I have mixed feelings on this .
    in the current risk averse climate and having seen the behaviour of some who go lineside this was always on the cards to happen . The domino's are toppling and railway after railway will probably follow

    The GC is not a line with a rich selection of publicly accessible locations and with no lineside access there is less incentive for those locations to be managed . Secondly with no access I suspect the amount of images for publicity purposes will diminish so press coverage and also contribution for guide books , timetables etc . There is also a risk that with no official access , people will take the decision into their own hands at possibly greater risk than managed

    Charters are the way forward but with the GCR your choice is limited which is a shame but that is a commercial GCR decision

    as a broader observation I can't help but feel the lineside fraternity has no one but itself to blame . We live in an age where self entitlement prevails and rules are there to be broken not observed , we seem to want it all on our terms .

    One especially vehement protestor on the subject thinks nothing of photting out of main line carriage windows despite all the instructions to the contrary . Another recently posted a GCR image from nature reserve land where there is no access. Gate was open was the excuse when challenged , didn't see a sign . That gate is never open and signs are aplenty . If we can't be trusted what do we expect ...
