    If the eviction is challenged and found to be invalid it will be the Plc paying departure costs..

    and relocation costs...
    and legal costs...
    and compensation...

    All of which might will bring the WSR down... or is that what you are hoping for?

    Then, I think you will see JPP Holdings make an attempt to buy the railway's assets from the receiver at pence in the pound, and no one will be able to stop him, the S&D trust will probably have to appoint high court sheriffs to recover assets that can be shown to have been in the ownership of the old PLC.

    And if they were to lose the action? I know what result I’d want, but there’s enough been said to suggest to me that it’s not an open and shut case in law.

    Yes, but it's hard to know if those opinions were dis-interested, or rather from people who had a reason to put their thumb on the scale.

    Mind, there's a good chance it's not open and shut - legal points often are, especially ones with 40 years of history to rummage through - but without paying my own solicitor to look through all the original paperwork (and how would an outsider get all that, some of it's closely held), how would one get a good, even-handed sense of how things balance? And of course even then, nobody can predict with 100.000% certainty what a judge (or jury, if one is used) will do.

    If the SDRT folds their tent, it may be to rule out having to roll the legal dice

    I think the S&DRT have more sense than to go to court. The Plc hasn't any money to pay them, even if they do win. It would be a Pyrrhic victory.

    If the S&DRT were to go to court they could start by demanding that the PLC puts up money to cover their costs were they to win, that alone could be interesting.

    you probably are right, but I believe the court of public opinion, certainly amongst informed people will come down against the PLC, It will be interesting, to see if the railway will have the nerve to have an S&D themed gala in the next few years, people would vote with their feet and go elsewhere because i doubt that the S&D Trust would be taking part, and of course, there will be no 53808

    Martin, you are correct that no one could stop JJP from making an offer in such circumstances, however that does not mean the administrator would accept the bid, nor would it stop a WSR group from placing a counter bid.
    However, this scenario is very much crystal ball gazing and I don't think it is helpful for anyone, so perhaps it would be best not to conjecture what might happen if a court case was to take place.

    I don't think that it will happen, as I don't see any events that aren't entirely pre-booked happening for the foreseeable.

    Well I can think of worse places than Dunster on heritage lines, including Goodrington near to you.
    Leaving Pickering there is a mile of stock, most in serious need of attention.
    The Stourport spur isn't exactly the beautyspot of the Wyre Forest.
    Bolton Abbey is like a graveyard for diesels.

    Not going to the WSR one of the best lines in the country because Washford are getting kicked out. :Saywhat:

    Departures in the fading light from Blue Anchor up that bank are some of the best experiences on a heritage railway I've had.

    Nope. Where did you get that idea from?
    The SDRT may not pay what the PLC want them to pay, but that's not the same thing They pay what's agreed in their lease.
    Well it's up to each person to make their own decision if they would return to the WSR after what has gone on. Personally I think it shows someone to have admirably high morals if they choose to boycott the WSR over what has happened.

    The WSR can use the land rent free was the point I was making, unlike the land at Williton.

    High morals is boycotting when your football team changes colours and crest because the owner is a nutter, not cause SDRT are leaving the WSR.

    Actually, based on events at Washford, I’d suggest the parallels between WSR and your football club scenario are quite strong.

    I grew up in SW London, within walking distance of Plough Lane; the last professional football game I saw was there. It’s now flats, and the side I watched are now MK Dons; the fans boycotted the decision of the owners to move the club and have set up their own replacement. Objecting to the board who forced the decision by refusing to give them money strikes me as highly moral.
