    I have spent some time with a tax inspector friend today and mentioned the gift aid rules.
    She was quite adamant that the tax rules took priority over CRA.
    Broadly, she outlined the points made above by Steve.

    First visit of the year today, the sun finally came out for the photogenic NER railcar.
    Sadly, the steam service all went wrong. Repton is the only Whitby equipped steam loco available but failed two days ago so the 31 runs the Whitby Grosmont section. The lunchtime train was 25 minutes late so in the end the Black Five did just this one run one way to Goathland, and the Whitby train got locked in at Whitby again by Northern, so in the end the Black 5 retired back to shed having ran a grand totoal of 12 miles, six of which were being towed ... Early season issues, hopefully.

    The railcar very much looked at home, very pleased with the shot at Thomson Foss.

    I can only suggest, perhaps not for the first time, that the NYMR Boards take their advice from more than one source of legal advice, other than the one appearing on here on a regular basis!

    So it appears that the 2.40pm from Whitby has been 'locked in' and ended up departing almost two hours late on 4 out of the last 6 operating days.

    That's an odd suggestion because 60044 is normally an advocate for reliance on volunteers rather than paid professionals.
    As has been apparent from posts on here the Gift Aid provisons of the 2007 Income Tax Act are very complex. So, before benefitting from Gift Aid on fares the Boards sought independent legal advice from a leading law firm with special expertise in that area. of the law.

    That's what appears to be happening from what realtimetrains is stating but obviously that doesn't show what the cause of the problem is as that must be on the NYMR part of the route, between Grosmont and Goathland.

    I acknowledge that advice from professionals is necessary in some cases and in this case I agree that it was right to seek it - but it appears from all that has been said on this form that it wan't very good advice!

    Not good advice based on the assumptions and understandings of several (presumably not qualified solicitors or tax specialist) posters on an internet forum? I’d much rather rely on one, you’d hope reputable, specialist with the appropriate professional liability caps relating to the advice, than an internet forum.

    The teaks are surely one of potential attractions for visitors. Leaving them in limbo does seem a poor policy.

    Yes. The section is from Glaisdale to Whitby so the Northern unit can't enter until the NYMR service is at Whitby. To save delaying the Northern service, the NYMR service is held until the Northern service has passed Glaisdale on the way out of Whitby.

    If a collection of non-professionals can pick the NYMR's current position to pieces, I suggest that the "professional" advice left an awful lot to be desired. Hopefully it will get sorted out and improved by more competent people before any serious damage is done. The one thing the NYMR can't afford is any more loss-making scenarios!

    On the contrary, I suspect it was entirely sound. What’s not clear is what question the advice was in response to, or what advice was sought on consumer matters, or how the two were brought together.

    Based on what @Lineisclear has said here, I very much doubt the tax and consumer elements were brought together in composite advice - had they been, I would have expected very different arguments for the treatment.

    So the customers have an enforced additional 2 hours in Whitby? Any knock on effects back at their destination- connections etc? I wouldn’t fancy having to amuse our very young grandkids for 2 hours, worse still if the promised steam loco hasn’t materialised either.

    I can’t say exactly what went wrong on each day but looking at the timetable it’s all a bit tight. The train from Whitby is due to arrive at Goathland at 13.15. The railcar should the get the token to leave Grosmont one minute later at 13.16, arriving at Goathland at13.31. Then the train for Whitby is scheduled to leave at 13.35, just four minutes later, arriving at Grosmont at 13.48 and departing for Whitby at 13.55. The section times are do-able but the station times are very tight. The Whitby train arriving at Goathland has to detrain before it can run into the loop, run round and the run back into the platform all within 15 minutes. In doing this the fireman has to uncoupled then walk to the ground frame, phone the Bobby, set the road, call the loco forward then put the frame back to normal and phone again before walking to the loco. It all takes time and, on the day I was there, the loco hadn’t run round before the railcar arrived. Passengers don't disembark and embark in a few seconds, either and this can eat quite significantly into the time available. Then, on the days when a diesel substituted for the Schools, a loco swap at Grosmont was necessary and doing that in seven minutes is nigh on impossible. Late running is going to be almost inevitable in these circumstances.

    Because they are highly trained athletes who can carry out run-rounds at five times the equivalent number of volunteers? Getting someone to examine the timetable with a view to making it more practical might be a better idea.

    I accept they may be an attraction to the general public once they are there, but you are going to really have to go some to convince me that they would get non enthusiasts to actually attend, rather then visit somewhere else in any meaningful numbers because of them.
