    As it's on the ship side of the rail, it's likely to be initially held against the ship as a matter of routine; however, a more pertinent question should be 'who was responsible for the lifting gear that failed?' - there will almost certainly be all sorts of checks made now on the gear that broke, for sure. Plus reviews of test records, manufacturing checks, risk assessments, check lists, crane operators' training, the list goes on... The ship's Safety Officer is in for a big task, as is the Master, never mind the shore personnel involved in the investigations.

    As was said earlier, all concerned should be thankful that no-one's been injured or worse.

    Presumably he meant the existing reliability of 47s and 56s. To be honest, I've got a lot of sympathy for the companies who simply selected the best available product - in so many instances since privatisation, the answer has been JT42CWR / Class 66. How many posters on here selected a Rover simply because it was British? Perhaps some, but if the customer has choices, then your product had better be competitive. The engineers have my sympathy - all too often lions led by management donkeys who terminally underinvested in their companies.

    When an item is shipped, its is usually delivered as 'free on board' which generally gives some exact definitions of where each parties responsibility begins and ends. I would imagine that the shipping company were probably fully liable until the locomotive was sitting on the rails, free of all fastenings etc and cleared by customs etc for removal from the docks. There should be no grey areas.

    In this case more likely it was DES.

    Delivered ex-ship I.E. ownership passing to the frieght company or leasing company when it was sitting on the quay side.

    In this case I would doubt that there was transfer of ownership.

    But at the end of the day, only someone who has seen the sales contract would know.

    BR had had many years to batter its fleet into working order but had failed. The customers were fed up with the lack of reliability that still existed so ordered the class 59s.

    Very true, whichever way, it is very unlikely that there would be any doubt as to who was liable at any stage of the delivery.

    It wont be scrapped for some time. Because it hasn't yet gone through the excruciating livery thread on Nat Pres. I should think that it will be some years before we get round to it, after all there are a number of steam loco's (kettles) to get through yet, and then we'll get onto modern traction (boxes). If any of us can stand the tedium for so long.:):

    [Tongue firmly in cheek/] I find the content of other threads on here to be of greater tedium - citing for example the Steam Railway magazine thread which recently slipped into a case of who has or hasn't received their copy, how long it takes to ship to some island in the pacific, who is or isn't giving up their subscription, and when the WHSmiths in Leicester had their stock arrive.... I couldn't give a whatsit!

    As for the nuances of Freightliner livery styles though....

    I,ve read on another site that it was actually the ship,s crane that dropped it and a "cable" snapped. This could have been the crane winding drum cable I suppose. Pictures show it went down on one end and it is truely bent. Apparently the chassis is bent, cracked axles, damaged wheels. The site is apparently sealed off at the moment.

    The ship,Beluga Endurance,arrived in Ghent this morning.There is a picture on another site showing a very bent 70012 sitting on a trailer on the quayside at Newport.
