They may have a covenant on other peoples property. Our first house had a covenant that claimed right of support up to about 10 feet from the back of our house. Our house was quite near the railway so I suppose we could have theoretically undermined the railway by excavation.

reading the thread , I have seen images taken from a lower angle by the fence on the new estate/railway boundary , as well as the traditional gatherings on the bridge itself

one observation and in a way it is a sad one , is that we often underestimate the stupidity (or lack of being informed) of people . It is often said people spend more time choosing a fridge than they do a house . These new residents even allowing for a railway in close proximity feel they have a reasonable right to privacy and not finding each weekend hordes of photographers milling outside their property . it seems one individuals tolerance has reached an apparently low limit and a campaign to stop these gatherings through fair means or foul has been launched .

I have seen one or two individuals venture down to the fence but on the whole photographers congregate around the bridge. Then again I usually visit this location in the morning when the sun would be wrong that side and rarely on gala days. I understand not wanting hoards by the fence in front of your house but don’t really see the objection to people on the bridge.

It is becoming a habit for many people; you only have to look at Trip Advisor reviews to see how they think.

A local restaurant, which is generally very good, occasionally gets people in who will finish their food, then complain and try to refuse to pay.

The thing I don't understand here is that, from what I can tell from various comments, the fences and saplings are on the bank - who owns the bank? I would have assumed it was the railway, not the householder? I'm pretty sure that digging up someone else's land to put up fences/trees is illegal...

Firstly, generally, neither the Great Central Railway plc, nor any of their supporting bodies, own any part of the railway (with the exception of the former Goods Offices at Loughborough, which are owned by the DCRT). The freehold rests with Charnwood Borough Council.

Secondly, specifically, the embankments on either side of Bridge 338 at Woodthorpe, and the roadway over the bridge, were - unusually - *never* owned by the railway. They remained the property of the local landowner, Sophia Perry-Herrick, and the railway had a right of access over them only for the purposes of construction and maintenance of works. Ownership of the embankments will presumably have passed to whoever purchased the surrounding land, but it certainly does not rest with either the railway or its landlord.

It seems some people are blustering, and others causing damage and a nuisance, under a significant misunderstanding.

I did notice that a rather out-of-place looking garden fencing panel seems to have been erected in the gap in the hedge on the approach to the bridge, from what I could see from the trains yesterday. Didn't seem to be too many photographers around either, which applied to the railway as a whole, not just in relation to this particular location.

Probably due to the weather. I attended the Last Hurrah event last year on the Sunday. The weather was much kinder and Kinchley Lane appeared to be heaving. <BJ>

The weather did get a bit dull at times, though I was more struck by the significant number of families and "normal" passengers who seemed to be attending rather than the die-hard enthusiasts, given that there is an enthusiasts bias with the running of the freight trains and relative exotica like the DMU+BG/Shocvan trailing load, which isn't your usual event fare. Don't know how many sampled the Hall+BG+Shocvan combination though!
