    Just been looking at the ECML on google earth. Using Great Heck as the half way point, the GNR part of the line has numerous public access points, i.e. level crossings and footpaths, but the NER part is like a fortress with very few footpaths and only one level crossing. Anyone got any ideas why this is?

    And, we are talking about the ECML north of York, maybe you failed geography, because that photo you mention is the wrong side of the pennine's.

    It is, railway trespass is a specific criminal offence with a penalty of £1000 fine. Civil trespass is just that and even if you refuse to move you cannot be arrested and a court order is required to effect removal which is what happens when travellers decide to pitch up on the village green. The law is gradually being changed though, it's now a criminal offence to squat in residential property.

    • Section 55 British Transport Commission Act 1949: this penalises trespass on railway lines or property in dangerous proximity to such lines or electrical apparatus. Evidence is required of a notice exhibited at the station nearest the place of offence providing a clear public warning not to trespass on a railway. Punishable by a fine."
    Seems no request to the trespasser to move on is needed under this legislation, though signage at the nearest station is. Lack of signage on stations isn't normally an issue these days :)

    That act has long been superseded, I believe the British Railways Act 1965 increased the fine to £200 and the 2002 bye laws took it up to £1000 maximum if you are prosecuted. 60017 can confirm this but I think in normal circumstances if you're collar is felt it's more likely you'll get a £80 fixed penalty.

    I know where Ais Gill is, it's in the NORTH where people don't trespass apparently. Did you ever see the BBC programme that came from Leeds NR control centre. Lots of trespass issues were highlighted on it and none involved steam trains although one mass trespass did involve a lot of beer.

    Railway Trespass is complete by the presence of an unauthorised person on Railway land - there is no need for refusal to remove oneself.

    Yer railway Bye Laws are different, just being there is an offence. However "there" is sometimes not a well defined or definite place.

    Its in the North West, not the area we are talking about, so geography is obviously not your strong point., and the most recent mass trespass occurred in February, in your neck of the woods, cant argue with facts, although you will.

    Like many points argued, it will take tragedy for people to wake up, saying it has been ok for time past, will be no excuse when the inevitable happens.

    All the arguments do, is provide ammunition to those who see "your" hobby, as proliferated by people who flout rules, and before you say those involved last time we joe public, how do you prove it, they are all tarred with the same brush.

    The next level down in the Network Rail planning barrel would be to show fake timings to places it's not going.

    Then let the PR department hand over the right timings to the media.
