If there was any evidence that the impact on property values had been taken into account the Local Planning Authority would be done for maladministration. The modern planning system is rooted in the 1947 Act but still there is this urban myth that property vales are relevant to a decision.

What is legally a planning consideration is largely mis-understood by the general public, and not for good reason.

When objecting to an adverse planning application it is always worth consulting a solicitor who knows about these things. Often a non- planning objection can be re-phrased and worked into a valid planning objection.

Some of this is evident in the replies/objections at Parracombe, which ultimately probably relate to 'nimby' stuff, but which have been honed into valid planning considerations. In other cases at Parracombe the objections are perfectly valid planning considerations without any legal input/advice.

    Cheers,
    Julian

I have been having a discussion with one or two people closer to the railway than I am and it appears that Mrs Grob, is the only one to have asked for any legal advice on this matter, all the other objections have been on the basis not in my back yard, so we shall have to wait to see if any of them hold any legal water or not.

The problem has been so far as the L&BR is concerned is that no one has taken the project seriously before now, but as the current management team have over the past few year produced a number of reports for both ENPA and NDDC to explain the added value of a rebuilt railway in this part of the country, people are now listening to what can be done and the benefits it can bring.

I have also been told that the previous owners of the Court Place Farm also objected to the railway back in the 1890's so there is nothing new about this, interestingly enough I have also been informed of a number of options should this plan hit a delay for any reason then this will not see the whole project just give up and walk away, I think either way it is exciting times as far as the new L&BR railway is concerned.

I suppose that if objectors don't live full-time in the village and earn their living in, say, London, they have a vested interest in rubbishing the economic forecasts, so they can enjoy the tranquility and isolation which was, presumably, the reason for their move there..

    Maybe

I live 100 yards from Stogumber Station, and have tranquility and isolation 96% of the time, and the occasional steam train which I used today to go to Minehead to do my shopping and meet a railway personage to do some paperwork.

I am now sitting at the garden table outside my house, drinking in the peace and listening to the goldfinches settling down for the evening.

Perhaps Mrs Grob would like to come and visit to see what is really like to have a heritage railway nearby as opposed to her fears.

Not everyone wants to go to amine head wherever that may be and however good the shops.

On a more serious note, we shouldn't think that everyone wants a steam railway near them no matter how infrequent the trains. Some people, oddly, buy houses in quiet locations because they like quiet locations.

Amine head? Sounds smelly to me ...

Being serious, I wonder whether long detailed discussion on public forum of the concerns of one particular property owner is not slightly counter productive? One assumes that the powers that be on the L&B are working hard to secure the land they need, but whether constant noises off - about the precise legal route to follow, and discussion of vaguely threatening compulsory purchase etc - is helpful to that process is an open question.

    Agreed.

But an opportunity to see what the real (as opposed to feared) impact has, to my direct knowledge, calmed one objection to a re-opening in the past.

Should those around the proposed line be invited to the WSR to sit by the line and see what its like for a day?

When the Association was first started Bill Pryor took a coach load of local residents up to the Ffestiniog Railway to show them what we had in mind to rebuild, you also have to remember that only a few year's before North Devon had just had the Ilfracombe line project go belly up and so the whole of North Devon was very aware of what can happen to a project, it is interesting to speculate on what could have been, had the Ilfracombe project become a success.

Pity they can't write a grammatical letter.... 'a maximum of two minutes are [sic] allowed'!! Since when is a maximum plural???
P.S. I got several of these too directly and can confirm this wording
P.P.S. The document tells you to check the Agenda online, but it's not even posted yet!

Good point and well spotted. I visited someone in hospital the other day and saw a sign pointing to OUT PATIENTS PARKING. I was tempted to go and watch them. You'd think that the NHS would know better though. Grrrrrr!!!
