    Given the resolution and distance identifying one individual from another is very difficult. Walk through any city street and your movements tracked by numerous cameras.What about the millions of dash cameras? Technically most of them are being operated illegally.

    True but the rail cams re an easy target. What about the millions of dash cameras, footage of which can subsequently viewed worldwide if it shows something interesting?

    Dashcam is if the owners decide to put it up on Youtube or Facebook. My Dashcam offers me the option to link to my phone and stream it - I don't take up that option, but others might.

    You need to think outside of the Bluebell Railway box.

    Legally I don’t doubt the complainant is strictly in the right. Actually any detriment he may suffer seems negligible. Of course a camera showing a direct view of a property theoretically might pose a security risk. IMHO the presence of such a security camera would be a deterrent to criminals because there are plenty of properties without coverage. On balance I think they are to be welcomed. My neighbour and I both have cameras that overlap and we both see this as beneficial.

    Might I suggest, and I am off to work at the moment, so cant, a reading of the relevant legislation as a starting point, that will show what can - and can not be done with CCTV systems.

    The difference is that, to the best of my knowledge, neither you nor your neighbour are streaming your videos online for anyone to view.

    Taking the stereotypical view that an Englishman’s home is his castle, I take the view that his discomfort at this camera angle outweighs any considerations of enthusiasts being denied views of Williton as a result.

    Taking the camera offline seems to me the least that should be done, whether legally, morally, or just in the interests of good neighbourly relations.

    All you saw was them going left to right or right to left on the road crossing, their house and garden were not in shot, nor were the parked vehicles. Once the sound was cut there was no risk of noise being broadcast. Unlike the bungalows opposite. If the objection came from there I would agree and fully support them.

    Those who subscribe to Railcam UK will find that several new international cameras have gone live overnight, one in Canada and several in the United States.

    Our overseas friends are obviously more liberal than us.

    As I understand it, it is lawful to film or photograph people without their consent in a public place so that is fairly straightforward. Outside of public places people have a right to privacy. However, if your garden is essentially in full view of the public and not behind a high wall, it is not regarded as a private place. However, filming and photographing is recording, which a live webcam isn't. It only falls into that category if someone records the live streaming. The GDPR appears to be singularly silent on webcams. If it isn't I've not found the reference. I suspect that, until these things are tested in a court of law, we will have no definitive answer.
    I'll hang my mess room lawyer hat up now and let Robin give a more informed comment if she wishes to do so.

    I am not a legal expert but my understanding is that no one has an inherent right not to be photographed, videoed, recorded etc.

    I largely agree. My point is that any detriment suffered is largely illusory. With the ever increasing proliferation of cameras people have become more concerned when little real harm is caused. That is not to say the law should not be obeyed. Nevertheless it is a great pity.
