    I know of one railway that did run a series of 'Thomas' specials. Thomas leaked like a sieve, and I refused to steam or drive it until I had seen the boiler ticket. Despite repeated requests, the Boiler certificate never showed up, and the railway then classed me as a troublemaker. They still ran it for 7 days.

    I didn’t know it didn’t need one if it’s not at a railway. Has it not got a ticket then? I was just wondering what happened in a railway if it didn’t have a ticket but they tried to run one

    Having not seen the video, I rather hope that it's an old video from when Ivor was last in ticket, being reposted under the claim of being for the NHS so that a few "likes" can be gathered up!

    I think @Azrall was just saying that the loco is at a private site - I don't believe he was commenting on the boiler certificate.
    The loco would still require a boiler inspection, testing and certification even at a private site, for insurance purposes.

    If a railway tried to run a loco without a boiler certificate, and once this came to light, they would run into serious problems with the ORR, the H&S Executive and the railway's insurance company. It would be quite likely that the railway would be closed down until the ORR / HSE / insurance company were satisfied that all the regulations were being followed properly. I believe that issues such as this are contained in the SMS that the railway would operate under. If there was any kind of accident while operating a loco without a boiler certificate then there would be likely to be even more serious consequences.

    I think @MattA is probably correct that this is an old video, re-edited in support of the NHS

    Yes I don’t mind if it was Ivor or not that did it but was wondering if it was that serious a railway could go to prison for it or if it was just a basic rule

    Being pedantic, the Pressure Systems Safety Regulations apply to boilers being used 'at work'. If you have it on private site and are just steaming it for pleasure there is no legal requirement to have it inspected by a competent person. Likewise, if your railway is entirely on private land and does not cross a public highway or carry passengers, ROGS does not apply. It is also up to the owner whether it is insured. For the avoidance of doubt, I am not suggesting that any right minded person should do this, though; although I believe it has happened in the past.

    Totally agree Steve. What you do on your own premises is up to you. Also agree that if there is a known issue, it is sorted.

    Indeed @Steve and @David Humphreys I just didn't want to confuse "City of Truro"
    Of course if you steamed an uninsured / uninspected boiler on private land and had friends/visitors they could potentially sue you for everything if an accident occurred and that's why you would be very silly to do so.

    Even though lots people aren’t fan of Ivor I think it’s good for fun and getting to get people’s involved I hope it stays as Ivor

    To answer the original question, the law round boilers comes under Health and Safety law. Breaching those laws has serious consequences, even if nothing went wrong. In this hypothetical situation, someone at the railway-most likely board member or director, or equivalent-would be held accountable and possibly prosecuted.

    Sorry hadn't been able to be on the forum for a few days, but as mentioned above I saw in the Facebook Group "Steam Trains in the UK". It is a private group so I don't think linking would work unless you are a member of the group.
    It does look like it is on a private site/land.
