    I was assuming those would go as a matter of course.
    The sensible thing for the S&DRHT is to either dismantle the buildings, move them to another site, as @61624 said was done with the ex NELPG shed and re-erect them on new foundations or to sell them, buyer to remove, for whatever they can get for them. The sensible thing for the WSRHT to do is to offer to buy them for the same price as any other buyer and save themselves the cost of dismantling, removing and new foundations which the other buyers will be factoring in in their offer. If the S&DRHT want to give the buildings away, I am sure there are plenty of charities who'd love to have them for the price of removal and re-erection. That would be doing the decent thing by the railway preservation movement.

    The S&DRT trustees do of course have to consider their own responsibilities to their charity: if the building has either capital value, or historic value in respect of their own charitable purpose, it may not be a simple matter to simply give it away, if that was seen as harmful to their own charitable interests.

    (Same argument, on a smaller scale, as the overhaul liability in respect of 53808: however much some might feel the best thing is a clean break with the WSR, that is not necessarily easy if the result was to write off a debt to another organisation, since you would have to justify that doing so was a prudent use of the charity's money).

    In the case of the building, I understand they have to remove it so it is in the first instance a liability and so a realistic offer to remove it free of charge may be better than the unknowns of selling it.

    Having said that there does seem to be a market for these things

    If they were to sue over 53808, would the PLC be able to pay or might it be forced into bankruotcy?

    Could we please distinguish correctly between the S&DRT (as at Washford) and the entirely separate S&DRHT (as at Midsomer Norton).

    They would only be able to sue if the WSR did not fulfil their part of the agreement. That cut off date is some years away, is it not?

    If the WSR plc, were to tell the trustees of the S&DRT, Sorry we can't afford to overhaul your engine, And in doing so broke the agreement, then, possibly if the trust pursued the PLC, It could result, if the railway was found to be accountable for the cost not just of overhauling the engine, but legal costs, tip the railway into bankruptcy, the latest information, is that the company have asked the charities to pay for the upkeep of the coaching stock, saying they don't have the funds, is that to do maintenance, or restoration? because if its to do maintaince, that's a very serious situation, and one the ORR certainly would show an interest about, Every railway now has to ensure their passenger carrying vehicles are maintained and inspected and those inspections are recorded on file, and its the company, not the charity who are responsible for ensuring the stock is in a fit state to run.

    Highly unlikely that the ORR will show any interest in whether the WSR can pay for the carriage maintenance. They will take interest if the maintenance is not done to the required standard, but the ORR do not care who pays for the maintenance.

    Crossing at Minehead has taken a good beating. Webcam shows staff attending to the damage (at least two barriers are bent).
