    And both operations have stewards a plenty! The Spa came through York the other week with one near enlugh every door way.

    What factors are different? I thought no heads out allowed and CDL, or stewards in the absense of it, are needed on all trains running on the national network.

    Done their job at being killjoys, yes.

    Factors that come in to safety cases - Type of train, speed of train, rolling stock, type of braking, Smokebox/tender first running, type of route, clearances of points on that route, likelihood of incident occurring, type of train check carried out before departure, PTI Risks, Agreed MOW…..I mean that’s just some.

    They’ve done their job. Their job is to regulate the safe running of trains. If they don’t think it’s safe they won’t sign it off.

    You wouldn’t expect a gas engineer to sign a dodgy boiler off in your house as safe. You wouldn’t expect a chef to serve you some food undercooked and say it was safe. You wouldn’t expecy builders to build sub standard property and say it was safe. In every scenario the operator/builder/chef/engineer (THE PERSON/ORGANISATION DOING THE WORK) is responsible! Not the regulator. So you’re argument is floored.

    @JBTEvans Which raises the rather obvious question of why WCRC are apparently able to steward these adequately but not the Jacobite?

    The regulator are just looking for issues, they are flawed.

    Anyway, made my point and let's leave it there. Hopefully the Jacobite runs again soon, albeit probably in a different way now and forevermore.

    I would assume as they aren't running twice daily in a remote part of the UK.

    They're not looking for issues. They found WCRC were lacking in their first inspection in June, and despite assurances it seems they found the same issues again in another inspection a month later.

    Don't forget WCRC have previous for not following the rules. Ironically, they've recently banned guided tours of Carnforth as someone didn't follow their rules published a photo in a book!

    Well perhaps there enlies the problem! The operations has outgrown its feasible staffing levels.
    So maybe it needs to cut back in order to staff the trains as it is required to do so!

    The Swanage 117 & 121 have CDL and the windows are restricted on how far they open.

    The regulator are there to prevent risks/safety issues turning in to something serious. Because I guarantee you now if you think this is bad, then you reaction would be off the scale if one of the unbolted doors were to come open and a person to fall out. Because it would be a very long wait for the Jacobite to run again were that the case.

    The ORR have found at least four issues of safety that they asked WCRC to improve and they have failed to do so. They’ve gone back, inspected for a second time, and found them to not only be just as bad, but worse in places! Who’s fault is it again?

    You are confusing two issues.

    One is what the regulations are, the other is about their enforcement.

    You are probably pushing at a semi-open door in querying the regulations around door locking on slam door trains, especially where they’re charter stock. It’s perfectly legitimate to question whether these regulations are necessary or proportionate.

    The second is the enforcement of the regulations. These exist, and WCRC operate under permissions granted in accordance with those regulations. I expect regulators to enforce the regulations they’re there to enforce, because when they don’t, no one knows where they stand. That includes regulations I might disagree with. And it really, really, includes regulations where the regulator has already recently read the riot act.

    Like you, I hope that the Jacobite is back up and running soon, using Mk1s. I also hope that it does so in a way that will meet ORR’s expectations when they restart, and then consistently thereafter.

    As @5944 has commented, WCRC haven’t got the cleanest of records with ORR. I therefore really, really, hope that the commitment to meeting the regulator’s standards is whole hearted and fully embraced by the whole organisation.

    The discussion about what are appropriate standards can then be separated, as it should be, from the discussion of this unfortunate period.
