    Now shown on the SRA website as sold for £35,000, not the £40,000 at which the hammer fell in the room, and to which, if the plate is genuine, as now attested, the vendor is entitled (less commissions)

    One assumes that the wining bidder wished to withdraw his bid despte the assertions made by the auctioneer. If the vendor agreed then this seems reasonable.

    The law of auctions does not work that way. If the hammer fell at £40k, and the auctioneers are adamant that the plate is genuine, and their website makes that clear, then the vendor is entitled to £40k less commission and the buyer is bound under the auction terms, as the plate is genuine.

    It leaves the auction house with a real dilemna, as they may not want to take on a buyer worth a reputed £200m, and perhaps they have come to a good old British compromise, but the website sale price is not what the hammer fell at.

    The auction house concerned has problems in this regard - as for instance - they continually try to say that the contract is not established until monies have changed hands - which is simply wrong. The contract is sealed when the next lot is offered as that concludes the period for a sale of the lot concerned and disputes thereafter can only be in respect of lack of authenticity, and not the management of the bidding process.
