    If the Patriot was done in rebuilt form it would look very much like a rebuilt Scot, of hich there are two examples already. At least in original form it fills a gap by representing the large Fowler parallel boiled era, of which there are currently no examples (unless you count Lord Nelson!).

    I see there is another artical in the just out heritage railway also, this goes into more detail, and reads even more alaming than the steam railway article, Acording to the latest report , some parts were taken after the injunction and damaged caused to the tender , and if the report is correct in this matter would this now not be a civil matter but criminal matter as to ignore a court injunction is an offence under criminal law rather than civil law? are we allowed to discuss this further on here or because there is a high likilyhood of police action now , are we best to not post anything until the thing is settled.

    The press has recently made mistakes in reporting matters which were then commented on by others, leading to all being sued for libel. Unless you have first-hand knowledge of events and have been given direct permission by either party in the dispute to post such information I recommend that you leave well alone.

    Why?

    There is nothing wrong with well-meaning speculation or opinion, provided it is described as such. The only danger is in passing off speculation or personal opinion as definitive fact.

    Stating that Heritage Railways are saying that the tender appears to have been damaged, and the photo evidence seems to back this up, isn't innaccurate in any way.

    The law is there to prevent libel and slander, not to stop us from discussing things that either HAVE happened or APPEAR to have happened and have yet to be conclusively established or dismissed. Provided there's no intent to harm anyone's reputation through mud-slinging, debate remains perfectly legal.

    I found the Heritage railway "report" a bit more reassuring as it shows the courts are on Mr Arkells side its just a matter of locating the missing parts. And yes it is a tricky subject and a sensitive one but unless you make stupid statements or telll private information, unless you know where the bits are, i dont see why its wrong its a forum and we can talk about it, but don't lock the thread the thread is about the engine not about the current problems its owner is going through with it at the moment.

    Indeed. The devil, it is said, is in the detail... but I do hope that this saga does have a positive result.

    I agree with other posters though; as long as we keep our comments factual & don't imply anything that might bring m'learned friends into play, then we're doing nothing wrong.

    Exactly, which is why the thread remains open.
    On a side note, two posters here did state what happened to the missing parts, however as it was not backed up by proof.. the post has been removed as almost certainly without proof could have caused serious issues. Indeed if true.. then it will probably be impossible to locate them which is part of the issue.
