    That's an interesting one if your scenario is correct. SG is stranded at York because of the steam ban. SG is needed for work elsewhere. WCR has to rescue it for operational and business reasons but must disassemble as it cannot be moved in light steam. This means that NR has knowingly affected the otherwise preferred practice of an independent railway company. Moving a loco with the rods off is not unusual but that does introduce some lubrication issues. I wonder whether NR has thought through possible liability issues here.

    NR should be sued big time for all extra costs, including labour costs, in doing this including any damage caused by doing so.
    Not to mention any loss of revenue caused by stranded locos.
    We already know the massive losses caused by the SSE cancellations which includes innocent traders as well.

    Agreed, if Network Rail are found at fault.
    We don't know that yet.

    Indeed arbitration (prior to going to court) is designed for parties to bring the matter to conclusion, often the output is that agreement is reached, but both parties bear their own costs.

    You can bet that to date the costs of this, combined both parties, are probably equal to the cost of an overhaul just by this far...
    If it ends in court, then a judge will decide, compensate and usually the loser pays the winners costs as well.

    One hopes arbitration brings a result, but todays light engine move suggests were away aways from knowing where things are... thats possibly not a good sign.
    The lack of public statements however is a good sign (as it suggests the parties are (or until recently were) talking to each other)

    First of all, I very much doubt that NR will have made any rash decisions on this subject, without first consulting their solicitors, to ensure that ANY decisions they make are at least within law and secondly, not going to cost the company any large amounts due to uninformed decision making, also, how do we know that the two parties have not already been through an arbitration process, without any one party accepting blame ! the upshot of which is that we may now be looking at a Court date to resolve matters. I doubt if this would have been made public if in fact this was the case.

    The interesting thing about this, from a legal and operational view, is how NR can decide that WCR have operational issues with the way they operate steam locos and don't meet the NR protocol, but only in one region! The fact that NR let them operate all over other parts of the network seems to me to seriously weaken any legitimate operational concerns.

    NR will have to show that the York Region has specific problems that do not arise elsewhere OR that the considered judgement of risk is such that a ban is the only option. If the transit of 5029 occurs without problem it will (1) strengthen NR's case that the ban is being applied to one operator for reasons of risk prevention but also (b) strengthen WCRC's case that as the only operator affected NR is imposing disproportionate penalties which require legal compensation.

    M' learned friends look like enjoying a Merry Christmas this year - especially since there has been no problem on either the S&C or WCML operations to date.

    Just seen on UKsteam info that Tangmere is off to Crewe next month. Does anyone know why? If it was for further repairs, I would have thought it would have gone to Carnforth.
