    Sorry im out of the loop now, so i dont know the answer, but given that they have ran this ED from tonbridge specially to do this, im of the impression that its going to be mothballed for another 12 months

    No, it does not become 'legally closed' through lack of use. It remains a statutary railway until it is officially abandoned.
